Terms of Service

Welcome to Influo. These Terms of Service ("Terms") govern your access to and use of the Influo platform, including our website at getinfluo.com and the application at app.getinfluo.com (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Influo, you confirm that you are at least 18 years old and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

2. Description of Service

Influo is a creator intelligence platform that provides Instagram analytics, content strategy recommendations, brand discovery, outreach tools, and media kit generation for content creators. The Service requires you to connect your Instagram Business or Creator account through Meta's authorized OAuth flow.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person may not maintain more than one active account

4. Instagram Connection

• To use analytics features, you must connect an Instagram Business or Creator account
• You authorize Influo to access your Instagram data through Meta's API as described in our Privacy Policy
• You can disconnect your Instagram account at any time through your dashboard settings
• You represent that you are the rightful owner or authorized administrator of the Instagram account you connect

5. Subscription Plans and Payments

• Influo offers Free, Starter ($29/mo), Growth ($79/mo), and Pro ($149/mo) subscription tiers
• Paid subscriptions are billed monthly or annually in advance via Stripe
• All prices are in US dollars and exclusive of applicable taxes
• You may upgrade, downgrade, or cancel your subscription at any time
• Refunds are available within the first 14 days of a new subscription. After 14 days, no refunds are provided for the current billing period
• We reserve the right to modify pricing with 30 days' advance notice

6. Free Trial

New users may be eligible for a 14-day free trial of paid features. No credit card is required for the trial. At the end of the trial period, your account will revert to the Free plan unless you subscribe to a paid plan.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to access other users' data or accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts or bots to access the Service beyond normal API usage
• Resell, redistribute, or sublicense access to the Service without our written consent
• Upload or transmit malicious code, viruses, or harmful content
• Use the Service to spam, harass, or send unsolicited communications
• Misrepresent your identity or affiliation with any person or organization

8. Intellectual Property

• The Service, including its design, code, algorithms, and branding, is owned by Influo and protected by intellectual property laws
• Your Instagram content remains your property. By connecting your account, you grant Influo a limited license to access, analyze, and display your content within the Service for the purposes described in our Privacy Policy
• You may not use Influo's name, logo, or branding without our written permission

9. Data and Analytics Accuracy

While we strive for accuracy, analytics data, AI-generated recommendations, and performance predictions are provided on an "as-is" basis. We do not guarantee that:

• Analytics will be 100% accurate or real-time
• AI recommendations will produce specific results
• Brand match suggestions will result in partnerships
• Growth forecasts will be achieved

You acknowledge that Instagram's API may have rate limits, delays, or occasional inaccuracies that affect the data displayed.

10. Limitation of Liability

To the maximum extent permitted by law, Influo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Service Availability

We aim for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.

12. Termination

• You may terminate your account at any time through your dashboard settings
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your right to use the Service ceases immediately
• Data deletion following termination is handled as described in our Privacy Policy

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms shall be resolved in the courts of Istanbul, Turkey.
